Silence that Speaks

Troy Davis has another chance,
For eighteen years, his home death row.
Eyewitnesses have changed their stance.
So did he kill? Most now say no.

From round the world, indeed the Pope,
Supporters asked the Supreme Court
To give not only Davis hope
But those who think our courts fall short.

Two judges took away my breath.
Scalia, Thomas in dissent
Believed one can be put death
Although he’s proven innocent.

As long as someone’s fairly tried,
The Constitution remains mute.
So said the two; Stevens replied,
Atrocious then to execute.

He spoke for the majority.
The Constitution once ignored
The ghastliness of slavery
And suffrage for which women roared.

So justices with life at stake,
The trial judge, gave back command,
Where silence reigns, such writs can wake
The living doctrine of our land.
